Exploring the Struggle for Trans Civil Rights: A Powerful Documentary Shows the Human Narrative

Trans documentarian Sam Feder's latest documentary "Increased Examination" provides a moving two-part perspective – simultaneously an intimate profile of a leading trans advocate and a sharp examination of journalistic coverage about transgender issues.

Legal Struggle at the Supreme Court

This feature documents ACLU lawyer Chase Strangio as he gets ready for oral arguments in the important Supreme Court case US v Skirmetti. This legal battle happened in late 2024, with the judiciary eventually deciding in support of the state's case, practically allowing bans on treatment for transgender young people to stay in place across numerous US states.

We made Heightened Scrutiny in only 16 months, stated Feder during a discussion. By contrast, my earlier film Disclosure took me five years, so this was quite rushed. Our goal was to raise discussion so people would learn more about the case.

Personal Story Amid Legal Battle

Although Feder provides a comprehensive analysis of how major publications have promoted transphobic talking points, the film's greatest contribution may be its captivating portrayal of Strangio. Normally a cautious attorney in public settings, Strangio reveals his vulnerability throughout the documentary.

That was a substantial challenge, to open up aspects of my life to a filmmaker that I had strived to keep private, stated Strangio. Feder explained he wanted younger people to know that we fought, to see what was done in defense of these battles for our basic existence.

Varied Perspectives in the Movement

To support Strangio's narrative, Feder features multiple transgender activists, including respected individuals from activism and entertainment. This film also includes viewpoints from cisgender allies who analyze how mainstream publications have added to harmful coverage of trans individuals.

The perspective of trans youth key to the court battle is represented through a impressive 12-year-old student named Mila. Audiences initially witness her advocating for her fellow students at a educational meeting, with later scenes showing her demonstrating for transgender rights outside the highest court.

Personal Moments Beyond the Legal Battle

The documentary also includes touching moments where Feder steps outside the ongoing legal struggle, including sequences of Strangio traveling in Italy and getting a tattoo featuring lines from activist Pauli Murray's poem "Prophecy."

This body art moment is among my preferred parts in the movie, explained Strangio. Getting inked is nearly like a reflective process for me, to be fully present in my body and to consider it as a vessel for things that are important to me.

Physical Autonomy and Representation

The filmmaker's focus to lovingly documenting Strangio adding to his tattoo collection highlights that Heightened Scrutiny is primarily about trans bodies – not only those of youth who confront denial of their right to live authentically in their own bodies, but also the physical forms of the numerous participants who participate in the film.

I create films with a message, and part of that is selecting people who are outstanding and concise enough to sustain the camera, shared Feder. When people ask me what they should wear for an filming, my reply is anything that makes you feel attractive. That is essential to me – as transgender individuals, we face challenges so much with our self-perception.

Impact and Optimism

One aspect that causes Feder's documentaries excel is his clear talent for making his trans interviewees feel at ease, recognized and appreciated. This technique creates authentic connection between Feder and Strangio, enabling the filmmaker to realize his aim of showing Strangio as a multifaceted human being and leaving a document for posterity of how resiliently he and others have fought for transgender liberties.

I hope not people to find themselves in a place of incessant hopelessness because of what the law is denying us, explained Strangio. I aim to be in a process of using the law to reduce harm, but not to turn it into some sort of conduit for our liberation aspirations. The government is not going to be the mirror through which we view ourselves. Trans people are that mirror, and it's really crucial that we persist having that discussion alongside discussions about pushing against these laws and practices.
